TRAVELLERS’ FIQH

FREQUENTLY ASK QUESTIONS (FAQ)

Preserving Wudhuk (Ablution)

“…..The water from one tap is too cold, while the other is too hot. But we have to do the ablution 5 times a day. Is there a solution ?”

It is indeed difficult to perform ablution during winter because the water is cold. Where occasionally ther are two taps on each sink (hot and cold) and the temperature difference of the water from each tap is big. In other words, one is too hot and the other is too cold. Perform the ablution as in mentioned by Allah swt in Al-Quran (al-Maidah:6). Only, it is not necessary to wash each part of three times. Once is sufficient but make sure the water passes thoroughly the entirely of each part.

It is very proper and even Sunnah to wear socks that coger up to over the ankles while in the state of having wudhuk and not taking it off. This is to ease us in doing ablution and solah everywhere. It is not necessary to put our feet in the sink to wsh it since this act is very inconvenient and troublesome and may also be seen as indecent. Do ablution as usual but replace tha washing of the feet with wiping the top side of socks with water. As in the hadith : “Hamman r.a. explained : One day, Jarir passed water and then performed abluiton and he wiped both of his shoes. A witness said: You are doing it like this ? Jarir answered: Yes! I saw the Prophet of Allah SAW passing water and then performing ablution and wiping the top side of his shoes which covered his ankles” – narrated by Bukhari

The period of using the socks or khuf is 3 days and 3 nights for travellers (musafir) whereas 1 day and 1 night for non travellers. Once the socks are taken off, it is necessaray to perform properly including washing of the feet.

Usage of socks or khuf’s  is not restricted to any situation of climate. It is but a blessing from Allah SWT to ease His believers.
"....مَا يُرِيدُ اللَّهُ لِيَجْعَلَ عَلَيْكُمْ مِنْ حَرَجٍ وَلَٰكِنْ يُرِيدُ لِيُطَهِّرَكُمْ وَلِيُتِمَّ نِعْمَتَهُ عَلَيْكُمْ لَعَلَّكُمْ تَشْكُرُونَ

“…..Allah doth not wish to place you in a difficulty, but to make you clean, and to complete His favour to you, that ye may be grateful. (Al-Maidah : 6)

" On no soul doth Allah place a burden greater than it can bear. It gets every good that it earns and it suffers every ill that it earns. (Pray): "Our Lord! condemn us not if we forget or fall into error; our Lord! Lay not on us a burden like that which Thou didst lay on those before us; Our Lord! lay not on us a burden greater than we have strength to bear. Blot out our sins and grant us forgiveness. Have mercy on us. Thou art our Protector; help us against those who stand against faith."

“On the authority of Aishah, who said, The Messenger of Allah SAW said: “He who innovates something in this matter of ours that is not of it will have it rejected.” (Bukhari and Muslim)

Jama’ and Qasar

“Prayer times often clash with lectures, and sometimes with exsminations. How do we pray in these conditions ?”

Jama’ (joining of 2 prayer in 1 prayer time)

When living in a non-Muslim country, no time is set aside for prayer. This problem often arises in winter when day time is brief causing the difference between the time for Dhuhr and Maghrib prayers to be very short. In such situations, it is allowed to do Jama’ of prayers due to the inconvenience faced to do the prayer on time, based on the actions the Prophet SAW combining prayers during rain, travelling (musafir), war etc. late scholars expanded the concept and meaning of inconvenience to suit the needs and necessities of the currnet age (1).

Travelling is not a condition that permits one to do Jama’ unless the situation of the traveller leads to inconvenience to do the prayers in their respective times. The inconvenience faced must be of which is certain and inevitable because doing prayers on their respective times is very important as stated in the Al-Quran:
“Verily prayers are enjoined on believers of stated time” (An-Nisa : 103)

Jama’ of prayes is to combine 2 obligatory prayersand doing it in one time which is combining Zhuhr with Asr and Maghrib with Isha. Only these combinations are permitted and there is no Jama’ for Fajr prayer. This is so because of no other examples shown by the Prophet SAW and an important method in an Ibadah to Allah is that it is compulsory to have existing evidence from Al-Quran or from Sunnah of the Prophet SAW.

Problems

Sometimes lectures or examinations carries on from before Dhuhr time until the time of maghrib. Therefore, in these situations, the students must act proactively by:
  • asking permission from the lecturer to go out for awhile to do solah
  • Finding time to do solah in between lectures
  • Eventhough this is a very case. As through experience, there has always been a certain period of time in between lectures in a day
If the inconvenience to do solah on time occurs on Fridays, Jama’ can be done for Friday and Asr prayers by doing the Friday prayers as usual, then getting up to do Asr prayer afterwards (2).

Jama’ of prayers must be done consecutively without separating the two prayers even with a recitation of dhikr. It is allowable to span the time between one prayer and the other only on essential grounds such  as renewing an invalidated wudhu’. Prayers must be done in order which means Dhuhr must be done before Asr and Maghrib before Isha (3). Details of the recital of the intentions are not required since it was never a practice of the Prophet SAW. Intentions lie in the heart and it is translated into conscious actions (4).

Qasar (shortening of prayers )

Qasar alone and jama’ with Qasar together can be only performed while on travel (musafir). Allah’s words:

When ye travel through the earth, there is no blame on you if ye shorten your prayer, for fears the Unbelievers will attack you” (An-Nisa : 101)

Ya’alaa bin Umayyah said: I asked Umar Al-Khattab r.a. about the verse: “When ye travel on earth, there is no blaming on you if ye shorten your prayers, for fear the Unbelievers may attack you,” whereas now, the people are at peace.

Umar replied: “I had wondered list like you so I can asked the Prophet SAW about this matter and he replied: That is a charity from Allah Azza wa Jalla to all of you, therefore take it.” (5) narrated by Muslim.
Qasar is shortening the prayer with 4 rakaats into 2 rakaats which are Dhuhr, Asr and Isha (6). The status of traveller (musafir) is obtained when one travels outside the range of his usual journeys and does not intend to reside at the place of destinations (7).

Example :

You are staying in Nottingham. You are regarded a traveller (musafir) it you went to Sheffield and stayed there for a few days. If inconvenient arises, you can do jama’and qasar. Otherwise, you can do qasar prayers for the whole time during the stay.

Sharing kitchen with non-muslim

“A flatmate of mine (non-muslim) often uses my kitchen utensils to prepared food. Do I have to wash the used utensils 7 times (first wash using water mixes with soil?

It is wrong or sinful to utilise kitchen utensils such as pans, bows and knives etc that have been used by non-muslims, with a condition that they be washed first.

It is not obligatory to wash the utensils 7 times (first wash using water mixed with soil). It is sufficient to wash them with water and washing liquid to the extent of eliminating the scent, and colour of the food on the utensils.

The following hadith narrated by Abu Dawud and considered Sahih (authentic) by al-Albani, in sahih Sunan Abu Dawud – Hadith no 3839 (Book of eating, Chapter : Eating with the utensils of the People of the Book) is referred to :

Tsa’labah al-Khusyani r.a. said, I asked the Prophet of Allah SAW: “Verily, we live together with people of the Book. They often cook pork (swine) in their pots and drink wine (liquor) in their glasses. Are we allowed to use these pots and glasses ? TheProphet of Allah SAW answered: if you can find other utensils, then eat and drink from them, if you cannot find other utensils, then wash those with water then eat and drink from them.” (1)

Related Problems

The same goes for the impureness of dogs since it is common among the people from abroad to bring dogs out of walks with them. It is not required of us to clean our clothes or body parts if they came into contact with a dog of if we stepped on dogs’ faeces except for when either of them came into contact with a dog lick. This is based on the hadith with the meaning:

“When a dog drinks form a container of one of you, wash it 7 times” (Sahih al-Bukhari – hadith no 172 – Book of Wudhu’. Chapter : if a dog drinks from a container…)

To the majority of Islamic scholars, this hadith is regarding the method of purifying the impureness of dogs only-not other than it (2). To Hanafi’s and Hambali’s school of thought, only dogs’ saliva is impure, not their body  parts (3).

Conclusion

A majority of scholars’opinion says eating pork and dog meat is forbidden(2). Even though, there are different opinions regarding the impureness of the two. Therefore the opinion mentioned before is very appropriate to be practised.
